Welcome to The Prime Gang, a sports and fitness company offering online workout classes, sports management, and facilities. By accessing or using our services, you agree to be bound by these Terms and Conditions ("Terms"). Please read them carefully.

1. General Terms

1.1 Acceptance of Terms: By accessing or using any part of our services, you agree to be bound by these Terms. If you do not agree, you may not use our services.

1.2 Modifications: The Prime Gang reserves the right to modify these Terms at any time. Changes will be posted on our website and will become effective immediately. Your continued use of our services constitutes acceptance of the revised Terms.

1.3 Eligibility: You must be at least 18 years old to use our services or have the consent of a parent or guardian.

2. Membership and Account

2.1 Registration: To access certain services, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

2.2 Membership Fees: Membership fees are due at the time of registration and are non-refundable. Memberships are valid for the duration specified at the time of purchase. The Prime Gang reserves the right to change membership fees at any time; however, any changes will not affect current memberships until renewal.

2.3 Account Termination: The Prime Gang reserves the right to terminate or suspend your account at any time for any reason, including violation of these Terms. You may also terminate your account at any time; however, no refunds will be issued for any unused portion of your membership.

2.4 Account Security: You agree to notify The Prime Gang immediately of any unauthorised use of your account. The Prime Gang will not be liable for any loss or damage arising from your failure to safeguard your account information.

3. Booking Policy

3.1 Booking Process: Classes and facilities can be booked through our website or mobile app. Bookings are subject to availability and are confirmed upon receipt of payment. You are responsible for ensuring that your contact information is accurate and up-to-date to receive booking confirmations and notifications.

3.2 Payment: Full payment is required at the time of booking. We accept major credit cards, debit cards, and other specified payment methods. All payments are processed securely.

3.3 Booking Confirmation: Upon successful booking, you will receive a confirmation email with the class or facility details. Please keep this confirmation for your records.

4. Subscription, Fees, and Charges

4.1 Subscription Plans: The Prime Gang offers various subscription plans for online workout classes and facility access. Details of the plans, including fees, duration, and benefits, are available on our website.

4.2 Payment Terms: Subscription fees are billed in advance on a monthly or annual basis, depending on the selected plan. Payments are non-refundable except as specified in our refund policy.

4.3 Fee Changes: The Prime Gang reserves the right to change subscription fees at any time. Existing subscribers will be notified of any changes at least 30 days in advance. Fee changes will apply at the next billing cycle.

5. Refund and Cancellation Policy

5.1 Cancellation by Member:

Cancellations for online workout classes must be made at least 1 hour before the class start time to receive class credit.
Cancellations for facility bookings must be made at least 2 hours before the scheduled time to receive a credit.

5.2 Cancellation by The Prime Gang:

If a class or facility booking is cancelled by The Prime Gang, you will be notified as soon as possible. You will have the option to reschedule or receive a credit.

5.3 Non-Refundable Policy:

All payments for classes, memberships, subscriptions, and other services are non-refundable. This includes but is not limited to, no-shows, late cancellations, and unused memberships or class credits.

5.4 Non-Transferable Policy:

Classes, memberships, subscriptions, and credits are non-transferable and may only be used by the individual who purchased them. Sharing or transferring your membership or class credits to another individual is strictly prohibited.

6. Termination and Suspension Policy

6.1 Termination by The Prime Gang: The Prime Gang reserves the right to terminate or suspend your account and access to services at any time, with or without notice, for any reason, including but not limited to violation of these Terms.

6.2 Termination by Member: You may terminate your membership or subscription at any time. Termination requests must be submitted in writing to dancewithtom@gmail.com. No refunds will be issued for any unused portion of your membership or subscription.

6.3 Effect of Termination: Upon termination, your right to access and use our services will immediately cease. All provisions of these Terms that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

7. Injury Concerns

7.1 Assumption of Risk: By participating in our classes and using our facilities, you acknowledge and accept the inherent risks involved in sports and fitness activities. You agree to participate at your own risk.

7.2 Release of Liability: The Prime Gang, its instructors, employees, and affiliates are not liable for any injuries, damages, or losses arising from your participation in our classes or use of our facilities. You agree to release and hold harmless The Prime Gang from any claims arising from your participation.

7.3 Medical Clearance: It is your responsibility to ensure that you are physically fit and capable of participating in our activities. We recommend consulting with a healthcare provider before starting any new fitness program.

8. Privacy Policy

8.1 Data Collection: We collect personal information in accordance with our Privacy Policy. This information includes, but is not limited to, your name, contact details, payment information, and usage data.

8.2 Data Use: Your personal information is used to provide and improve our services, process payments, communicate with you, and for other purposes outlined in our Privacy Policy.

8.3 Data Security: We implement appropriate security measures to protect your personal information. However, no internet-based service can be completely secure, and we cannot guarantee absolute security.

8.4 Third-Party Services: We may use third-party services to process payments, manage bookings, and provide other functions. These third parties are obligated to protect your information and use it only for the purposes for which it was provided.

9. Intellectual Property

9.1 Ownership: All content provided by The Prime Gang, including but not limited to text, graphics, logos, images, videos, and software, is the property of The Prime Gang and is protected by intellectual property laws.

9.2 Use of Content: You may not use, reproduce, modify, distribute, or display any content from our services without prior written permission from The Prime Gang. Unauthorized use of our intellectual property is prohibited.

10. Governing Law

10.1 Jurisdiction: These terms shall be governed by and constructed in accordance with the laws of India without reference to conflict of laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of courts, tribunals, fora, applicable authorities at Bangalore.

11. Communications

You hereby expressly agree to receive communications by way of SMS and/or e-mails from the Company, Vendors and other third parties relating to the Platform Services provided through the Platform. You can unsubscribe/ opt-out from receiving communications through SMS and e-mail anytime by e-mailing to dancewithtom@gmail.com. However, this may limit the extent of Platform Services that you can avail.
